Second parent adoption
Second
parent adoption is not legal in all states. Please contact a local
attorney to know your state laws.
In a second parent adoption, a non-biological parent is given the
ability to be a legally recognized parent to the child of his or
her partner, thereby allowing the child both financial security
and emotional stability from two legally recognized parents.
A second
parent adoption of a child by one partner in a same-sex relationship
is similar to the adoption of a child by a stepparent in a heterosexual
relationship.
Like
a child with two biological parents, a child with one biological
parent and one adoptive parent is entitled to the family benefits,
such as health insurance, social security and pension benefits,
from both parents. In the unfortunate case of the death or incapacitation
of a biological parent, a partner who has adopted his or her partner
child can continue to provide a home for the child. Additionally,
in the event of the death of the non-biological parent, the child
is entitled to all entitlements as the legal heir to the non-biological
parent.
