Sperm Donor Agreement
Should
you or your partner wish to have a child with the help of a sperm
donor, you may either choose to use an anonymous sperm donor from
a reproductive laboratory or have someone you know and trust be
a sperm donor. In the latter situation, the fact that the donor
is known can give rise to some legal issues should the donor want
to have a different relationship with the child at a later time,
so it is highly recommended that you and your partner create an
agreement with the donor (and his partner, if he has one) setting
out the type of relationship, if any, the donor is to have with
the child, as well as provisions regarding any financial, legal
and emotional obligations the donor may have towards the child.
It
is also important for couples to know that if one partner is to
be carrying the child, she will be considered the biological mother;
her partner is, in the legal sense, a stranger to the child unless
that non-biological partner adopts the child as a second parent.
